Terms of Use (Acceptable Use Policy)

Effective: 1 April 2026


Summary

These terms define what is and is not permitted when using the platform photoselect.app. Respect the rights of others, do not upload illegal content, and do not attempt to circumvent the system's security. Violations may result in suspension or termination of your account.


1. Introductory Provisions

1.1. These Terms of Use (hereinafter "TOU") set out the acceptable use rules for the platform photoselect.app (hereinafter "Platform") operated by:

(hereinafter "Provider")

1.2. These TOU supplement the Terms and Conditions and the Privacy Policy. In case of conflict, the Terms and Conditions prevail.

1.3. By registering and using the Platform, the User agrees to comply with these TOU.


2. General Rules of Use

2.1. The User must:

  • a) provide truthful and up-to-date information during registration and in their profile,
  • b) protect their login credentials and not allow third parties to access their account,
  • c) use the Platform in accordance with its purpose (photo album management, photo selection, ordering photo products),
  • d) comply with the applicable laws of the Slovak Republic and the European Union,
  • e) respect the rights of other Users and third parties.

2.2. The User acknowledges that the Platform is intended for persons aged 16 and over. Persons under 16 may use the Platform only with the consent of a legal guardian.


3. Prohibited Conduct

3.1. The following is prohibited on the Platform:

3.1.1. Content and Photographs

  • a) Uploading, sharing, or distributing content that violates the laws of the Slovak Republic, including but not limited to content depicting child sexual abuse material (CSAM), non-consensual pornography, or other illegal content.
  • b) Uploading content that infringes on copyright, trademarks, or other intellectual property rights of third parties without appropriate authorisation.
  • c) Uploading photographs of persons without their knowledge or consent, where required by applicable law.
  • d) Uploading content promoting hatred, violence, discrimination, or terrorism.
  • e) Uploading viruses, malware, or other harmful code.

3.1.2. Security and System Integrity

  • a) Attempting to gain unauthorised access to other Users' accounts or administrative functions.
  • b) Circumventing the Platform's security mechanisms (authentication, authorisation, access control).
  • c) Attempting to systematically download or copy Platform content (scraping, crawling) without prior written consent.
  • d) Intentionally overloading the Platform's servers with an excessive number of requests (DDoS, brute-force attacks, etc.).
  • e) Manipulating URLs to access files or albums the User is not authorised to access.
  • f) Misusing the impersonation feature for purposes other than technical support.

3.1.3. Commercial Conduct

  • a) Using the Platform for purposes for which it is not intended (e.g. mass sending of unsolicited messages, fraud).
  • b) Impersonating another person or entity.
  • c) Providing access to your account to third parties for payment or free of charge.
  • d) Creating multiple accounts to circumvent restrictions or conditions (including repeatedly using the trial period).
  • e) Abusing the trial period for commercial purposes without the intention of activating a subscription.

4. Photographer Obligations

4.1. In addition to the general rules, photographers as business users of the Platform must:

  • a) Ensure they have all necessary permissions to upload and process photographs (including consent of photographed persons and/or their legal guardians).
  • b) Inform their customers that their data and photographs are processed through the Platform.
  • c) Set prices in the price list truthfully and in compliance with applicable law.
  • d) Not share their customers' login credentials with third parties.
  • e) Use the impersonation feature (logging in on behalf of a customer) exclusively for technical support purposes and with the knowledge of the affected customer.
  • f) Ensure their activities on the Platform comply with the GDPR and applicable data protection legislation.

4.2. The photographer acknowledges that their content and albums are separated from other photographers' content (multi-tenancy isolation) and they have no access to data belonging to other photographers or their customers.


5. Customer Obligations

5.1. The Customer must:

  • a) Use the Platform exclusively for browsing albums, selecting photographs, and placing orders.
  • b) Carefully review their selection before locking the album, as the selection cannot be changed after locking.
  • c) Not share their account credentials or album links with unauthorised persons.
  • d) Not reproduce, copy, or distribute photographs from albums without the photographer's consent.

6. Demo Accounts and Albums

6.1. The Platform may contain demo albums and demo accounts intended for demonstration purposes.

6.2. Demo content is intended for viewing only. Any attempts to modify demo content (other than by administrators) are technically blocked.

6.3. Users must not misuse demo content for commercial purposes or attempt to extract demo photographs.


7. Intellectual Property and Licences

7.1. Copyright to photographs uploaded to the Platform belongs to the photographer or the original author. The Provider does not acquire any ownership rights to User content.

7.2. The User grants the Provider a limited, non-exclusive licence to process uploaded content (creating watermarks, thumbnails, displaying in gallery) exclusively for the purpose of providing the Platform's services.

7.3. The Customer has no right to reproduce, copy, or distribute photographs from albums without the photographer's express consent, except for personal use within the ordered products.


8. Consequences of Violations

8.1. In the event of a violation of these TOU, the Provider reserves the right to:

  • a) Warning — send the User a warning and request for remedy.
  • b) Temporary suspension — temporarily restrict or suspend access to the account.
  • c) Account termination — permanently terminate the User's account and delete related content.
  • d) Content removal — remove content violating these TOU without prior notice.

8.2. In the event of suspected criminal activity, the Provider is obliged to cooperate with law enforcement authorities and provide them with relevant information in accordance with applicable law.

8.3. The Provider will apply measures under Section 8.1 proportionate to the severity of the violation. For less serious violations, the User will first be warned and requested to remedy the situation.

8.4. Termination of a photographer's account due to a TOU violation does not give rise to a right to a refund of paid subscription fees.


9. Reporting Violations

9.1. If a User becomes aware of a violation of these TOU by another User or of illegal content on the Platform, they are encouraged to report it to: mdfoto.sk@gmail.com.

9.2. The report should include:

  • a) a description of the violation or illegal content,
  • b) identification of the affected content (album name, URL, screenshot),
  • c) contact details of the reporter.

9.3. The Provider will investigate each report and take appropriate action within a reasonable time.


10. Limitation of Liability

10.1. The Provider is not responsible for content uploaded by Users to the Platform. Responsibility for uploaded content lies exclusively with the User who uploaded it.

10.2. The Provider is not liable for damages resulting from:

  • a) a User's violation of these TOU,
  • b) unauthorised account access due to insufficient protection of login credentials by the User,
  • c) technical failures or service outages caused by circumstances beyond the Provider's control.

11. Changes to the Terms of Use

11.1. The Provider reserves the right to amend these TOU at any time.

11.2. Users will be notified of significant changes by email or announcement on the Platform at least 14 days before the changes take effect.

11.3. Continued use of the Platform after the changes take effect is considered acceptance of the amended TOU.


12. Governing Law and Dispute Resolution

12.1. These TOU are governed by the laws of the Slovak Republic.

12.2. Any disputes will be resolved by the competent courts of the Slovak Republic.
