Terms and Conditions

Effective: 1 April 2026


Summary

These Terms and Conditions govern the rules of using the platform photoselect.app operated by DOMAN s.r.o. The platform allows photographers to manage photo albums and their customers to select photographs for printing, photo canvases, and 3D lamps. Photographers receive a 30-day trial period. Photo selection is binding once an album is locked. Payments are made by cash or bank transfer — we do not process payment cards.


1. Introductory Provisions

1.1. These Terms and Conditions (hereinafter "T&C") govern the rights and obligations between:

(hereinafter "Provider")

and

users of the platform photoselect.app (hereinafter "Platform"), being:

  • a) Photographers — business entities using the Platform to manage photo albums and communicate with customers,
  • b) Customers — individuals using the Platform to select photographs and place orders through a photographer.

(hereinafter collectively "Users")

1.2. By registering on the Platform, the User expresses agreement with these T&C.

1.3. These T&C are governed by the laws of the Slovak Republic, in particular Act No. 513/1991 Coll. Commercial Code (in relation to photographers as business entities), Act No. 40/1964 Coll. Civil Code (in relation to customers as consumers), Act No. 250/2007 Coll. on Consumer Protection, and the GDPR.


2. Description of the Service

2.1. The platform photoselect.app is a SaaS (Software as a Service) solution that enables:

  • a) Photographers: uploading photo albums, customer management, setting price lists and watermarks, tracking order status, managing operations through an administration interface.
  • b) Customers: browsing photo albums, selecting photos for printing, ordering photo canvases, ordering 3D photo lamps, communicating with the photographer through the Platform.

2.2. The Provider is not a party to the contractual relationship between the photographer and their customer. The Platform serves as a technical tool for facilitating communication and order processing.

2.3. Photographs uploaded to the Platform are automatically processed — a watermarked copy and a reduced thumbnail are created.


3. Registration and User Account

3.1. Use of the Platform requires registration. When registering, the User must provide truthful and complete information: first name, last name, email address, phone number, and password.

3.2. After registration, the email address must be verified by clicking on a link sent to the provided email address.

3.3. The User is responsible for keeping their login credentials confidential. In the event of suspected unauthorised access to the account, the User must immediately change their password and notify the Provider.

3.4. The password must contain at least 6 characters.

3.5. The Provider reserves the right to cancel an account that violates these T&C or the Terms of Use.


4. Photographer Registration and Trial Period

4.1. A photographer may register as an independent business user (tenant) of the Platform.

4.2. Upon photographer registration, a 30-day free trial period (hereinafter "trial") begins. During the trial, the photographer has access to all Platform features including album uploading, customer management, and price list settings.

4.3. After the trial period expires, the ability to upload new albums will be suspended until the subscription is activated by an administrator.

4.4. Subscription price after the trial period: €19 per month. Prices are stated exclusive of VAT; if the Provider is a VAT payer, VAT will be added at the statutory rate.

4.5. Subscription activation is carried out by agreement with the Provider. The Provider reserves the right to refuse subscription activation without giving a reason.


5. Services for Photographer Customers

5.1. The Customer registers on the Platform independently or is invited by the photographer. In both cases, the customer is linked to the respective photographer.

5.2. The Customer has access via the Platform to photo albums created for them by their photographer.

5.3. Photo selection: The Customer selects photos in the album for printing and specifies the number of copies for each format. The Customer may also order a photo canvas in multiple sizes and 3D photo lamps.

5.4. Album lock: After completing the selection, the Customer confirms (locks) the album. Once locked, the selection cannot be changed. Locking the album is considered a binding confirmation of the order.

5.5. All prices displayed in the album are set by the photographer, and the relationship between the photographer and the customer is governed by the conditions agreed between them.


6. Orders and Payments

6.1. Orders are created through the Platform based on the customer's selection in the respective album, or through a 3D photo lamp order.

6.2. Types of orders:

  • a) Photo printing (formats: 10x15 cm, 13x18 cm),
  • b) Photo canvas (sizes: 30x45, 60x40, 90x60, 120x80 cm),
  • c) 3D photo lamp (4 photos per lamp), with option for personal pickup or postal delivery.

6.3. Payment methods:

  • a) Cash payment (upon personal pickup),
  • b) Bank transfer.

6.4. The Platform does not process credit or debit card payments. We do not collect or store any payment card data.

6.5. Service prices are stated inclusive of VAT unless otherwise indicated. The photographer is responsible for correctly setting prices in their price list.

6.6. Order status progresses through the following stages: awaiting retouch → in retouch → sent to print → ready for pickup → completed.


7. Cancellation and Returns

7.1. Once an album is locked, the photo selection cannot be changed or cancelled. Locking is considered a binding order.

7.2. As the Platform's services are in the nature of digital content and personalised products (selection and printing of specific photographs), the consumer expressly agrees to the commencement of the service provision before the withdrawal period expires, in accordance with applicable consumer protection legislation governing digital content and personalised goods.

7.3. In the event of a demonstrable print or production defect, the customer has the right to make a complaint under Section 8 of these T&C.

7.4. 3D photo lamp orders may be cancelled before production begins (status "paid"). Once the status changes to "in production", cancellation is not possible.


8. Complaints

8.1. The Customer has the right to complain about defects arising during printing, photo canvas production, or 3D photo lamp production within the statutory warranty period of 24 months from receipt. Apparent defects (e.g. incorrect printing, damage during transport) must be reported by the customer without undue delay, within 30 days of receipt at the latest.

8.2. Complaints must be submitted by email to mdfoto.sk@gmail.com with photographic documentation of the defect.

8.3. Complaints will be handled in accordance with applicable consumer protection legislation, within 30 days of submission at the latest.

8.4. A complaint does not apply to subjective dissatisfaction with the photo selection after the album has been locked.


9. Provider's Liability

9.1. The Provider provides the Platform "as is" and makes reasonable efforts to ensure its availability and functionality.

9.2. The Provider is not liable for:

  • a) the content of uploaded photographs (the photographer is responsible),
  • b) the relationship between the photographer and their customers,
  • c) the accuracy of prices set by the photographer,
  • d) temporary unavailability of the Platform due to maintenance, updates, or circumstances beyond the Provider's control (force majeure),
  • e) data loss due to circumstances beyond the Provider's control.

9.3. The Provider's total liability to the photographer is limited to the amount of fees paid by the photographer in the last 12 months.

9.4. The limitation of liability under Section 9.3 does not apply to damages caused intentionally or by gross negligence.


10. Upload and Storage of Photographs

10.1. The photographer uploads photographs to the Provider's servers. Upon upload, watermarked copies and thumbnails are automatically created.

10.2. The photographer declares that they have all necessary permissions to upload and process photographs through the Platform, including the consent of persons photographed where required by applicable law.

10.3. The Provider does not acquire any ownership or copyright to the uploaded photographs. Photographs remain the property of the photographer.

10.4. The photographer acknowledges that image files are accessible via direct URLs without additional file-level authentication (see Privacy Policy, Section 7).

10.5. The Provider reserves the right to delete photographs and albums in accordance with the retention periods set out in the Privacy Policy.


11. Intellectual Property

11.1. The Platform, its design, source code, logos, and all related materials are protected by copyright and belong to the Provider.

11.2. The User may not copy, modify, distribute, or otherwise reproduce any part of the Platform without the prior written consent of the Provider.

11.3. Content created by Users (photographs, order data) remains their property. The Provider has a licence to process this content exclusively for the purpose of providing the Platform's services.


12. Impersonation

12.1. The Platform allows impersonation exclusively for technical support purposes:

  • a) The Administrator (Provider) may log in on behalf of any User other than other administrators.
  • b) The Photographer may log in on behalf of their own customers.

12.2. Impersonation is visually indicated in the Platform interface (information banner).

12.3. During impersonation, all actions are performed in the context of the impersonated user. The photographer/administrator is responsible for actions taken during impersonation.


13. Termination of Use

13.1. Customers may request deletion of their account at any time by email to mdfoto.sk@gmail.com. Account deletion will not affect already locked albums and processed orders.

13.2. Photographers may stop using the Platform at any time. After termination, their data, albums, and customer data will be retained for the period specified in the Privacy Policy and then deleted.

13.3. The Provider reserves the right to suspend or cancel a User's account in the event of:

  • a) violation of these T&C or the Terms of Use,
  • b) non-payment of the subscription after the trial period expires (in the case of a photographer),
  • c) suspicion of unauthorised or fraudulent activity,
  • d) inactivity for more than 24 months.

14. Consumer Protection

14.1. If the User is a consumer, the relevant consumer protection provisions apply.

14.2. The consumer has the right to contact an alternative dispute resolution body. The list of alternative dispute resolution bodies is available on the website of the Ministry of Economy of the Slovak Republic: www.mhsr.sk.

14.3. The consumer may also contact the Online Dispute Resolution (ODR) platform at: https://ec.europa.eu/consumers/odr/.


15. Final Provisions

15.1. These T&C are effective from 1 April 2026.

15.2. The Provider reserves the right to amend these T&C at any time. Users will be notified of significant changes by email or announcement on the Platform at least 14 days before the changes take effect.

15.3. Continued use of the Platform after the changes take effect is considered acceptance of the amended T&C.

15.4. Legal relationships not covered by these T&C are governed by the applicable laws of the Slovak Republic.

15.5. Any disputes will be resolved by the competent courts of the Slovak Republic.

15.6. If any provision of these T&C becomes invalid or unenforceable, the remaining provisions remain in full force.
